These sites would have an incredible amount to gain if they sued any agency that
applied the ban to poker tournaments specifically. They could sue in US
Disctrict court. In fact I bet tournament poker will be exempted precisely this
way.

the laws of the United States wouldn't apply to them.

Basic law 101: they cannot sue in a US court for relief from those laws.
